Advertising:
Whilst AndysDirectory.com does not review every advertisement posted to the Site, we reserve the right to withdraw without notice to the Advertiser (at our option) any advertisement that may be in breach of any clause of this agreement or of any law or regulation. We also reserve the right to terminate this agreement if the Advertiser posts any advertisement that may be in breach of any law or regulation. Further, we reserve the right to, in its absolute discretion, reject or remove any advertisement from the Site for any reason.
Customer Undertakings:
The Customer undertakes and warrants to AndysDirectory.com that no Advertisement will:
- breach or infringe any Trade Practices in the respective country/countries that the Listing is viewable (not limited to selected countries when listing was placed);
- infringe copyright, trade mark or other intellectual or moral property rights of any person;
- contain material that is obscene, offensive, defamatory, or otherwise unsuitable for publication;
- breach or infringe any laws relating to therapeutic goods, financial services, anti-discrimination, political publication, publication of court or tribunal materials, or any State or Commonwealth legislation, rule or ordinance; or
- give rise to any liability on AndysDirectory.com, cause AndysDirectory.com to be in breach of any law by virtue of publishing the Advertisement, or result in a claim being made against AndysDirectory.com
By submitting or authorising submission of an Advertisement for publication or Advertising, the Customer indemnifies AndysDirectory.com (and its employees, officers and agents) against any proceedings, demands, losses, costs (including legal costs on a full indemnity basis), damages and other liabilities of any nature taken, made or awarded against or incurred by AndysDirectory.com (and/or its employees, officers and agents) in connection with the Advertisement or any Advertising.
No Guarantees or Warranties:
- AndysDirectory.com does not guarantee that the Customer’s product featured in an Advertisement will be the only product of that type featured in Advertisements on any one page. AndysDirectory.com will not be responsible or liable to the Customer in any way if the Customer’s request cannot be granted, or the product featured in the Customer’s Advertisement is not the only product of that type featured in Advertisements on any one page.
- Online Advertising will be published via internet accessible Advertisement serving software (“Software”). AndysDirectory.com makes no warranties of any kind, whether express or implied of the fitness of this Software for a particular purpose. AndysDirectory.com shall not be liable for any loss, damage, or expense incurred in connection with AndysDirectory.com’s use of the Software, including without limitation, for any technical malfunction, computer error or loss of data or other injury, damage or disruption of any kind other than as a result of AndysDirectory.com’s gross negligence or fraud.
AndysDirectory.com will not be liable under these conditions or otherwise in law and the Advertiser acknowledges that AndysDirectory.com excludes liability under these conditions and in law for any indirect, special, economic or consequential loss or damage suffered or incurred by The Advertiser or loss of revenue, profits, goodwill, data or opportunities or loss of anticipated savings whether caused by negligence or otherwise and whether or not AndysDirectory.com was aware or should have been aware of the possibility of such damage.
To the extent permitted by law, all other representations, conditions or warranties, whether based is statute, common law or otherwise, are excluded. Liability of AndysDirectory.com for any breach of a term or condition implied by law is limited, at AndysDirectory.com's option to the supply of any service again or the payment for the cost of having any service supplied again.
